FacialDNA AI ("we," "us," or "our") operates the FacialDNA AI platform accessible at facialdna.ai and app.facialdna.ai (the "Service"). This Privacy Policy explains how we collect, use, disclose, and safeguard your information when you use our Service. Please read this policy carefully. If you disagree with its terms, please discontinue use of the Service.

We may collect the following categories of information:

Wallet Address: When you connect a Web3 wallet, we collect your public wallet address. This is required for authentication and to associate your activity with your account.

Generated Content: AI-generated portrait images you create using our Service. You may optionally submit reference photos; these are processed in real time and are not permanently stored on our servers beyond the active generation session.

Usage Data: Information about how you interact with the Service, including pages visited, features used, timestamps, and interaction patterns. This is collected automatically.

Device and Technical Data: IP address, browser type, device type, operating system, and referrer URLs — collected automatically to operate and improve the Service.

Referral Data: If you participate in our referral program, we record the referral link used and associate your account with the referring user.

Points and Reward Activity: Your on-platform activity, including check-ins, generations, and reward accumulation.

We use the information we collect to:

• Provide, operate, and maintain the Service
• Process and deliver AI-generated portraits
• Calculate and distribute points and rewards
• Enable the referral program and leaderboard features
• Monitor and analyze usage patterns to improve the Service
• Detect and prevent fraudulent activity, abuse, or violations of our Terms of Service
• Communicate with you regarding Service updates, policy changes, or support
• Comply with legal obligations

We do not sell your personal information to third parties. We do not use your generated images to train our AI models without your explicit consent.

Reference Photos (Optional): If you choose to upload a reference photo for generation, the image is transmitted securely to our AI processing infrastructure and used solely for the purpose of generating your portrait. Reference photos are not stored permanently after the generation is complete.

Generated Images: AI-generated portraits you create are stored and associated with your account for gallery and history functionality. You may delete your generated images at any time from within the dApp.

No Biometric Database: We do not build or maintain a biometric database from user images. Facial data is not extracted or retained in a biometric form.

Third-Party AI Processing: Image generation is powered by advanced AI models. Processing may occur on third-party infrastructure. We ensure contractual data handling protections are in place with all AI processing partners.

Certain interactions — including wallet connections, token transactions, and on-chain activity — are recorded on the Kaia Mainnet blockchain. Blockchain data is public and immutable by design. We have no ability to modify or delete on-chain records. Your public wallet address is a blockchain identifier and is not considered private information in the context of public blockchains.

We use cookies and similar technologies to:

• Maintain session state and authentication
• Remember your preferences
• Analyze usage patterns and performance
• Detect fraud and abuse

You may disable cookies through your browser settings; however, certain features of the Service may not function correctly without cookies. We do not use cookies for cross-site advertising tracking.

We may share your information with:

Service Providers: Third-party vendors who assist in operating the Service (hosting, AI processing, analytics). These parties are contractually obligated to process data only as directed by us.

Legal Requirements: We may disclose information if required by law, court order, or government authority, or if we believe disclosure is necessary to protect our rights, your safety, or the safety of others.

Business Transfers: In the event of a merger, acquisition, or sale of assets, your information may be transferred as part of that transaction. We will notify you of any such change.

Aggregated/Anonymized Data: We may share aggregate statistics that do not identify individual users.

We do not share your data with advertisers or data brokers.

We retain your data for as long as your account is active or as necessary to provide the Service. You may request deletion of your account and associated data at any time by contacting us at privacy@facialdna.ai. Certain data may be retained for legal compliance, fraud prevention, or dispute resolution purposes even after account deletion. On-chain data cannot be deleted.

We implement industry-standard technical and organizational measures to protect your information, including TLS encryption for data in transit and access controls for data at rest. However, no method of transmission over the internet is 100% secure. We encourage you to protect your wallet private keys and seed phrases — we will never ask for these.

The Service is not directed at individuals under the age of 18. We do not knowingly collect personal information from minors. If you believe a minor has provided us with personal information, please contact us at privacy@facialdna.ai and we will take steps to delete such information.

Depending on your jurisdiction, you may have the right to:

• Access the personal information we hold about you
• Request correction of inaccurate data
• Request deletion of your data (subject to legal retention requirements)
• Object to or restrict certain processing
• Data portability

FacialDNA AI operates globally. Your information may be processed in countries other than your country of residence. By using the Service, you consent to the transfer of your information to countries that may have different data protection laws than your jurisdiction.
